1. Introduction
These Terms and Conditions govern the delivery of materials by Justin Taylor Companies LLC (“JTC,” “we,” “our,” or “us”) to all customers (“you” or “customer”). By placing an order for delivery, you acknowledge and agree to abide by these terms. These terms are intended to inform customers of delivery procedures, associated risks, and necessary conditions for a successful delivery.
2. Acceptance of Terms
By using our delivery services, you agree to these Terms and Conditions. If you do not agree, you should not place an order for delivery.
3. Changes to Terms
JTC reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website or other official communication channels.
a. Conduct and Safety: Customers must not harass drivers or damage delivery equipment.
c. Time Window Disclaimer: While JTC will make every effort to deliver within the selected time window, external factors such as traffic or prior deliveries may cause delays. JTC is not liable for any inconvenience caused by such delays.
d. Cancellation Policy:
– Full refunds are available for cancellations made at least 48 hours before the scheduled delivery time.
– Cancellations within 48 hours of delivery will result in a 50% refund.
– Cancellations within 6 hours of delivery are non-refundable.
e. Delivery Pricing & Payment:
Payment must be made in full before delivery unless otherwise agreed upon in writing.
a. Driveway and Property Risks:
Customers acknowledge that deliveries are made using dump trucks weighing between 20-40 tons. JTC is not responsible for any damage to driveways, pavement, or other surfaces due to the truck’s weight. If the truck enters the customer’s yard, indentations or ruts may occur, for which JTC is not liable.
b. Curbside Delivery Restrictions:
JTC delivers all orders curbside unless otherwise requested by the customer. Any requests for alternative delivery locations (e.g., driveway, job site, or beyond curbside) must be communicated in advance and are subject to the JTC driver’s discretion based on accessibility, safety, and site conditions.
c. Overhead Clearance:
The dump truck bed must be raised approximately 20 feet to unload materials. Customers must ensure there are no obstacles such as trees, limbs, buildings, structures, or power lines that may interfere with the dumping process.
d. Terrain Requirements:
Deliveries cannot be completed on a slanted or uneven surface, as this poses a rollover risk for the truck. If the designated drop location is unsafe, the driver reserves the right to refuse delivery.
e. Weather-Related Restrictions:
Due to weather inconsistencies and unpredictability JTC reserves the right to reschedule deliveries at its sole discretion due to adverse weather conditions that may impact the safety, efficiency, or quality of delivery and materials. Given the inherent unpredictability of weather, JTC will assess conditions accordingly and make scheduling adjustments as necessary to ensure optimal service and product integrity.
6. Limitations of Liability
Materials may vary in composition due to seasonal changes, weather conditions, and moisture content. While JTC makes every effort to provide consistent material quality, we cannot guarantee uniformity due to external environmental factors. JTC is not liable for variations in the delivered materials.
7. Termination of Service
JTC reserves the right to cancel and (full or partial) refund a delivery at its sole discretion if conditions are deemed unsafe, if the customer is uncooperative, or if unforeseen circumstances prevent completion of the delivery.
